Ohio Will Not List Lake Erie As Impaired…

…so conservation groups sue EPA to force listing under Clean Water Act

“We hope that EPA will get this one right and deny Ohio’s list, because it doesn’t currently include Ohio’s portion of western Lake Erie”

Conservation and other special interest groups filed suit today against the Environmental Protection Agency, claiming the federal agency is not complying with the Clean Water Act in providing protections for Lake Erie against harmful algal blooms.

At issue is a lack of response from the EPA on Ohio’s list of impaired waterways: the list does not include Lake Erie.

The lawsuit seeks to compel the EPA to make a decision on whether the lake should be included on the Ohio’s list of impaired waterways.

Molly Flannigan, vice president of policy at the Alliance for the Great Lakes, tells WDET’s Amy Miller that Ohio needs to be forced to include Lake Erie, just as Michigan has done.
