48th District Judge Kimberly Small is being challenged for her tough sentencing to first-time drunk driving offenders. Attorney Robert Larin along with Wayne State University professor Kenneth Mogill say that Small is violating the constitutional rights of defendants by sentencing almost all first-time drunken drivers to jail time.
