Marvin Gabrion was convicted and sentenced to death for drowning a woman who he had raped. The death penalty is not usually an option in Michigan but the murder took place in a lake that is federal property and that's why Gabrion was eligible for the death sentence. That said, the ruling was recently appealed because Gabrion's lawyers were unable to tell the juror's that if he were prosecuted in Michigan state court, he would not be eligible for the death penalty.
Craig sits down with Peter Henning, Criminal Law Professor at Wayne State University, to pick apart this case and recent ruling.
